Terms of Service

These Terms govern your use of Vask (vask.dev), a Pusher-compatible WebSocket service operated by ADDFUEL LTD, a company registered in England and Wales (number 17048912, registered office 3 Eider Close, Thornton-Cleveleys, England, FY5 2UT).
By creating a Vask account or using the service, you agree to these Terms. If you don't agree, don't use the service.
1. Definitions
- "Vask", "we", "us": ADDFUEL LTD trading as Vask.
- "Customer", "you": the entity (or, where you have authority to bind one, its representative) that creates a Vask account.
- "Service": the Vask WebSocket infrastructure, dashboard, APIs, documentation, and any related products at vask.dev.
- "Account": your Vask billing entity. An Account contains one or more Apps (configuration spaces with their own keys, secrets, and origins).
- "App": a configuration object inside your Account. Apps are not separate billing units.
- "Dev App": an App configured for local development only, and not for production traffic. Dev Apps may carry relaxed usage limits or be excluded from the monthly broadcast allowance.
- "Plan": the published tier you have subscribed to (Side Project, Indie, Team, Business, or Scale).
- "Customer Data": data you or your end-users transmit through the Service.
2. The Service
Vask provides a managed WebSocket service compatible with the Pusher Channels protocol. Subject to your Plan limits and these Terms, you may create Apps under your Account and use the Service to connect clients, broadcast events, and manage realtime channels.
We may add, change, or remove features. We won't materially reduce a feature you're paying for without at least 30 days' notice.
3. Account & eligibility
You must be at least 18 and able to enter binding contracts. You're responsible for everything that happens under your Account, including all activity by your end-users and anyone using your App keys or secrets. Keep credentials safe.
You may not use the Service if you're a sanctioned person, or based in a sanctioned country, under UK, EU, or US law.
4. Plans, fees, and billing
Plans, prices, and included usage are published at vask.dev/pricing. By subscribing you authorise us (via Stripe) to charge your payment method on each renewal until you cancel.
- Plans renew monthly. We don't offer annual prepayment.
- You may cancel any time from the dashboard. Cancellation takes effect immediately, and your service stays live until the end of the current billing period; after that the App keys stop working.
- Prices exclude VAT and other applicable taxes, which we'll add at the rate in force where required.
- We may change prices on 30 days' notice; existing customers keep current pricing through the remainder of the current billing period.
Refunds
UK consumers have a 14-day cooling-off right under the Consumer Contracts Regulations 2013, except that this right ends once you've used the Service substantively (e.g. broadcast more than a trivial number of events). For business customers, fees are non-refundable except where required by law.
Overages and fair use
Each Plan includes a monthly server-broadcast allowance and a daily burst capacity. We use a soft-overage model:
- At ~80% of monthly allowance: we email you a warning.
- At 100%: we email you again. Service continues.
- At 120% or 48 hours past 100%, whichever is later: we may reject new server broadcasts with a billing error until you upgrade or the next billing period begins.
We may also enforce immediately where there is origin abuse, payload-size violation, presence-cap violation, connection-open abuse, or sustained rates that threaten Service health. Specific operational limits (peak concurrent connections, payload size, rate limits, presence members per channel, etc.) are published in our docs and may be updated; material increases require no notice and material reductions require 30 days' notice.
"Apps" are unlimited under fair use. Excessive App counts, always-hot Apps, high single-channel fanout, or sustained event rates above your tier may require a Scale plan or a discussion with us.
Dev / local Apps
Dev Apps exist to make it free and frictionless to build against Vask locally. They are not for production traffic. You may not (a) misrepresent the origins of any App, (b) use a Dev App to serve a production website, mobile app, or end-user product, or (c) use any other mechanism (proxying, origin spoofing, key-sharing, automation that mimics local traffic, etc.) to obtain Dev-tier limits for production traffic. We may immediately suspend, downgrade, delete, or reclassify any App we reasonably believe is misclassified or whose declared origins do not match the traffic we observe, and we may bill the relevant usage as if the App had been on its correct paid tier from the date the misuse began.
5. Acceptable use
You agree not to use the Service to:
- send spam, unsolicited bulk messages, or content that violates law (UK, EU, or wherever it's received)
- harass, threaten, defame, or infringe rights of any person
- distribute malware, run phishing, or attempt to compromise other users
- attempt to circumvent Plan limits, rate limits, or fair-use safeguards
- misrepresent an App's origins, environment, or intended use, or use a Dev App for production traffic
- reverse-engineer, decompile, or scrape the Service except as expressly permitted by law
- use the Service for any content involving children's exploitation, terrorism, or illegal sales
We may suspend or terminate your Account immediately for material breach.
6. Customer Data and privacy
You retain ownership of all Customer Data. You grant us a worldwide, royalty-free licence to host, process, and transmit Customer Data solely to provide the Service.
Where Customer Data includes personal data of your end-users, our Data Processing Agreement (vask.dev/legal/dpa) applies and forms part of these Terms. Our handling of personal data about you, the Customer, is described in our Privacy Policy (vask.dev/legal/privacy).
You're responsible for the lawfulness of Customer Data, for having any consents or legal bases needed to send it through the Service, and for telling your end-users about your use of Vask where required.
7. Service availability
We aim to keep the Service highly available and publish operational status at status.vask.dev, which is the source of truth for current incidents and planned maintenance. We do not offer formal uptime guarantees or service credits.
8. Intellectual property
We own the Service. You own your Customer Data and your Apps' configuration. Nothing in these Terms transfers IP between us. You may use our name and logo to say you use Vask; you can't imply endorsement.
Feedback you give us about the Service is non-confidential and we may use it freely.
9. Confidentiality
Each party will protect the other's confidential information using at least reasonable care, and will only use it to perform under these Terms. App secrets and account credentials are confidential.
10. Warranties and disclaimers
We provide the Service "as is" and, to the maximum extent permitted by law, exclude all implied warranties (including merchantability, fitness for purpose, and non-infringement). We do not warrant that the Service will be uninterrupted or error-free.
Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, fraud, or any UK statutory consumer rights).
11. Limitation of liability
Subject to clause 10:
- Neither party will be liable for indirect, special, incidental, consequential, or punitive damages, lost profits, lost revenue, lost data, or business interruption, even if advised of the possibility.
- Each party's total liability for all claims arising under or relating to these Terms in any 12-month period is capped at the greater of (a) £100 or (b) the fees you paid us for the Service in the 12 months preceding the event giving rise to the claim.
12. Indemnity
You will indemnify and defend us from third-party claims arising from your Customer Data, your end-users' use of your App, or your breach of these Terms. We will indemnify you from third-party claims that the Service as provided by us infringes a UK intellectual-property right (subject to standard exclusions).
13. Termination
You may cancel any time from the dashboard. We may suspend or terminate immediately for material breach (including non-payment, abuse, or sanctions violation) or on 30 days' notice for any reason. On termination we'll stop billing and delete your Account data within 30 days, except where retention is required by law.
14. Changes to these Terms
We may update these Terms. Material changes take effect 30 days after we email registered Customers and update the "Last updated" date above. Continued use after the effective date is acceptance.
15. Miscellaneous
- Governing law and jurisdiction: these Terms and any dispute are governed by the laws of England and Wales, with the exclusive jurisdiction of the English courts (subject to mandatory consumer-protection law in your country of residence).
- Notices: to us, by email to [email protected] with copy to [email protected]. To you, by email to your Account contact and/or via the dashboard.
- Assignment: you may not assign these Terms without our consent. We may assign on notice to a successor in interest.
- Force majeure: neither party is liable for failure caused by events outside reasonable control (war, government action, infrastructure outage, etc.).
- Entire agreement: these Terms (with the Privacy Policy and DPA) are the entire agreement between us regarding the Service.
- Severability: if any provision is unenforceable, the rest stands.
